To become the owner of state property in the Republic of Belarus is possible in cases of privatization of objects of state property, alienation of state property. For the implementation of investment projects and construction of capital structures (buildings, constructions) in Minsk there can be granted a plot of land and for the organization of activities for temporary paid possession real estate can be leased.

4.1. The issues of reorganization and privatization of state property in the Republic of Belarus are regulated by:

Decree of the President of the Republic of Belarus No. 3 of March 20, 1998 "On privatization of state property in the Republic of Belarus";

Law of the Republic of Belarus No. 2103-XII of 19.01.1993 "On privatization of state property and reorganization of state unitary enterprises into open joint-stock companies";

Law of the Republic of Belarus No. 169-3 of 15.07.2010 "On the facilities that are only in the ownership of the state, and the types of activity for the implementation of which there extends the exclusive right of the state";

Regulations on the procedure for holding a tender for the selection of another, except for the state, founder of an open joint-stock company established in the process of transformation of a state unitary enterprise approved by the Decree of the Council of Ministers of the Republic of Belarus No. 1929 of December 31, 2010;

Regulations on the procedure for holding auctions for the sale of privatization facilities approved by the Decree of the Council of Ministers of the Republic of Belarus No. 1929 of December 31, 2010;

Regulations on the procedure for holding tenders for the sale of privatization facilities approved by the Decree of the Council of Ministers of the Republic of Belarus No. 1929 of December 31, 2010;

Regulations on the procedure for determining the initial price for the sale of shares (stakes in statutory funds) of business entities owned by the Republic of Belarus approved by the Decree of the Council of Ministers of the Republic of Belarus No. 1929 of December 31, 2010;

Regulations on the procedure for holding a tender for the transfer of shares of open joint-stock companies belonging to the Republic of Belarus or an administrative-territorial unit to trust management, including the right to purchase part of these shares based on the results of trust management approved by the Decree of the Council of Ministers of the Republic of Belarus No. 1929 of December 31, 2010;

Instructions on the procedure for conducting works on the reorganization of republican unitary enterprises into open joint-stock companies approved by the Resolution of the State Property Committee of the Republic of Belarus No. 3 of January 18, 2011;

Instructions on the procedure for determining the appraised value of an enterprise as a property complex of a state unitary enterprise in the course of privatization, the size of the statutory fund of an open joint-stock company created in the process of reorganization of a state unitary enterprise, the value of the property of the state unitary enterprise annexed to an open joint stock company approved by the Resolution of the State Property Committee of the Republic of Belarus No. 1 of January 4, 2011;

Instructions on the procedure for the sale, on preferential terms, of the shares of open joint-stock companies which are located in the communal property of the city of Minsk and created in the process of transformation of municipal legal entities, approved by the Decision of the Minsk City Council of Deputies No. 155 of September 2, 2011;

Instructions on the procedure for the exchange of shares of open joint stock companies, which are located in the communal property of the city of Minsk and created in the process of privatization of state property, to personal property checks "Imushchestvo" for the citizens of the Republic of Belarus through separate units of the open joint-stock company "Savings Bank "Belarusbank", approved by the Decision of the Minsk City Council of Deputies No. 155 of September 2, 2011;

Instructions on the procedure for determining the initial price for the sale of shares (stakes in statutory funds) of business entities owned by the city of Minsk, approved by the Decision of the Minsk City Council of Deputies No. 68 of November 24, 2010;

4.1.1. Bidding is regulated by:

Decree of the President of the Republic of Belarus No. 232 of May 5, 2009 "On some issues of holding auctions (tenders";

Regulations on the procedure for organizing and holding auctions for the sale of land in private ownership;

Regulations on the procedure for organizing and holding auctions for the right to conclude lease contracts for land plots;

Regulations on the procedure for organizing and holding auctions for the sale of state property and land in private ownership or the right to conclude a lease contract for a land plot for servicing real estate;

Regulations on the procedure for organizing and holding auctions with conditions for the right to design and build capital structures (buildings, constructions);

Regulations on the procedure for organizing and holding auctions for the sale of state-owned projects without the sale of the right to conclude a lease agreement for a land plot necessary for servicing the alienated property, approved by Decree of the Council of Ministers of the Republic of Belarus No. 462 of March 26, 2008;

Regulations on the procedure for organizing and holding auctions (contests) for the sale of certain state-owned projects, approved by Decree of the Council of Ministers of the Republic of Belarus No. 609 of July 12, 2013;

Regulations on the procedure for holding auctions for the sale of the right to conclude contracts for the lease of capital structures (buildings, constructions), isolated premises, car places, parts of them that are in state ownership, approved by Decree of the Council of Ministers of the Republic of Belarus No. 1049 of August 8, 2009;

Regulations on the procedure for organizing and holding auctions for the sale of state-owned real property with the establishment of an initial selling price equal to one base value determined by legislation, approved by Decree of the Council of Ministers of the Republic of Belarus No. 905 of October 3, 2012;

Regulations on the procedure for conducting electronic auctions for the sale of state property, including land plots, the right to conclude a lease contract for state property, including land plots, approved by the Council of Ministers of the Republic of Belarus No. 608 of July 12, 2013.

4.1.2. The order of alienation of state property is approved by:

Decree of the President of the Republic of Belarus No. 294 of July 7, 2012 "On the procedure for disposing of state property;

Decree of the President of the Republic of Belarus No. 677 of November 16, 2006 "On certain issues of disposal of municipally-owned property and acquisition of property in the ownership of administrative territorial units;

Decision of the Minsk City Council of Deputies No. 87 of April 25, 2000 "On the order of management and disposal of the property of Minsk";

Resolution of the Council of Ministers of the Republic of Belarus No. 905 of October 3, 2012 "On measures to implement the Decree of the President of the Republic of Belarus No. 294 of July 4, 2012 and introduction of amendments and additions to some resolutions of the Council of Ministers of the Republic of Belarus". 

4.1.3. Provision of land plots is defined by:

Decree of the President of the Republic of Belarus No. 667 of December 27, 2007 "On seizure and provision of land plots";

The Code of the Republic of Belarus on Land No. 425-3 of July 23, 2008;

Decree of the Council of Ministers of the Republic of Belarus No. 462 of March 26, 2008 "On certain measures to implement the Decree of the President of the Republic of Belarus No. 667 of December 27, 2007";

Decree of the Council of Ministers of the Republic of Belarus No. 223 of February 20, 2007 "On some measures to improve architectural and construction activities";

Decree of the Council of Ministers of the Republic of Belarus No. 427 of March 20, 2008 "On the establishment of a standard form of the agreement on the lease of land";

Decision of the Minsk City Executive Committee No. 3315 of December 26, 2013 "On some issues of organization and conduct of auctions as regards land plots in Minsk in 2014".  

4.1.4. Lease of real property is envisaged by:

The Civil Code of the Republic of Belarus;

Decision of the Minsk City Executive Committee No. 1441 of May 8, 2012 "On the establishment of coefficients for the location of buildings, structures, markets and shopping centers in the city of Minsk;

Decision of the Minsk City Executive Committee No. 1878 of June 14, 2012 "On the establishment of raising coefficients to the rate of rental payment for trading places and the recognition of certain decisions of the Minsk City Executive Committee as invalid";

Decision of the Minsk City Executive Committee No. 3845 of December 13, 2012 "On the approximate form of the contract for the lease of capital structures (buildings, constructions), isolated premises, car places, their parts owned by the city of Minsk and the approximate form of the contract for free use of capital structures (buildings, constructions), isolated premises, car places, their parts, which are in the ownership of the city of Minsk ".

In the territory of the city of Minsk, issues related to the management and disposal of state property are under the jurisdiction of the Minsk City Territorial Fund of State Property (hereinafter referred to as the “Minskgorimuschestvo” Fund, the Fund) which is a structural sub-unit of the Minsk City Executive Committee and the territorial body of state administration of the State Property Committee of the Republic of Belarus (hereinafter referred to as Goscomimushchestvo).

With the exception of the enterprises sold by the Fund, shares in open joint-stock companies established in the process of transformation, real estate projects owned by the city of Minsk, the organizer of auction / competitive bidding for the sale of state property, property of legal entities under contracts with them, as well as for sale of property located in the territory of Minsk but which is arrested, confiscated, turned into the property of the state is a municipal unitary enterprise "Minsk City Real Estate Center".

4.2. Privatization of state property with investor’s participation Privatization of state property - sale of privatization facilities to subjects of privatization in accordance with the procedure and on terms established by legislative acts of the Republic of Belarus.

Decisions on privatization are taken on the basis of the decision of the President of the Republic of Belarus, the Council of Ministers of the Republic of Belarus, privatization bodies that determine the method, the initial selling price (price) and other conditions for the sale of the privatization object, as well as solve other issues related to privatization.

The work is carried out in accordance with the approved plans for the reorganization of state-owned enterprises into open joint-stock companies.

The issues of reorganization into JSC and privatization of state-owned enterprises as property complexes through sale at auction are under the jurisdiction of the Department of Expert Examination of State Property Assessment and Reform of State Property.

Privatization bodies are the Republican Body of State Administration for the Management of State Property, its territorial bodies, local executive and administrative bodies that act in the privatization and reorganization of state unitary enterprises into open joint-stock companies on behalf of the Republic of Belarus or administrative-territorial units as owners of state property. By decision of the President of the Republic of Belarus, certain powers of privatization bodies may be exercised by other state bodies (organizations).

The projects of privatization are:

enterprises as property complexes of state unitary enterprises;

shares (shares in statutory funds) of economic entities that are owned by the Republic of Belarus or are in the ownership of administrative-territorial units.

Projects not subject to privatization are those that are only owned by the state, unless otherwise stipulated by laws, acts of the President of the Republic of Belarus.

The entities that acquire state ownership in the process of privatization may be:

natural persons, including individual entrepreneurs;

foreign citizens;

persons without citizenship,

legal entities of the Republic of Belarus, with the exception of state organizations and business entities in the statutory funds of which the number of shares (the stake) belonging to the Republic of Belarus and (or) its administrative and territorial units exceeds 50 percent;

foreign states and their administrative-territorial units;

international organizations;

foreign legal entities; foreign organizations that are not legal entities

4.2.1. Methods of privatization. Privatization is carried out by sale of:

shares (stakes in statutory funds) at an auction;

shares (stakes in statutory funds) by tender;

enterprises as property complexes at an auction;

enterprises as property complexes by tender;

shares of an open joint stock company based on the results of trust management.

 Sale of a privatization object without holding an auction (tender) is carried out in the event of the sale of shares of an open joint stock company based on the results of trust management and in other cases approved by the President of the Republic of Belarus.

Sale of shares (shares in statutory funds) and enterprises as property complexes at an auction is carried out when the buyer is not required to fulfill any conditions.

Sale of shares (stakes in statutory funds) and enterprises as property complexes is carried out by tender when the buyer is required to meet certain conditions provided for in the decision on privatization.

The participation of investors in the creation of the company at the stage of transformation of a state enterprise when state enterprises are transformed into open joint-stock companies, founders of open joint-stock companies created in the process of transformation of state unitary enterprises, are privatization bodies. Other, apart from the state, founders of open joint-stock companies may be privatization entities that have made monetary and (or) non-monetary deposits to the statutory funds of open joint-stock companies.

4.2.2. Holding a tender for the choice of OJSC founders  

The choice of the founders, apart from the state, is carried out by the privatization body by holding a tender.

The organizers of the tender for choosing another, apart from the state, founder of an open joint-stock company, are:

for republican unitary enterprises with the number of employees 1000 people or more - the State Property Committee;

for republican unitary enterprises with the number of employees less than 1000 people - regional (Minsk City) territorial funds of state property;

for municipal unitary enterprises - the relevant local executive and administrative bodies.

The organizer of the competition:

fixes the date, time and venue of the tender;

provides publication in print mass media of an information message on the conduct of the tender, as well as placement in the global computer network of the Internet of information on the announced tender;

sets up a commission to conduct a tender (hereinafter - the commission);

accepts applications for participation in the tender with the attached documents;

performs other functions.

The terms of the tender are determined by state bodies and state organizations to which the state unitary enterprise is subordinate and transformed into an open joint-stock company on the basis of the development strategy of this enterprise.

4.2.3. Conducting direct negotiations on the choice of the founder of OJSC.

In case the tender is recognized as a failed communication with the fact that the application for participation in the tender is submitted only by one participant, the tender organizer conducts direct negotiations with the sole participant that submitted the bid. When both parties agree to fulfill the conditions of the tender, a protocol on the results of direct negotiations shall be signed.

Decision-making on the choice of other, apart from the state, founders of OJSC

Based on the results of the tender or direct negotiations, the head of the republican unitary enterprise being transformed into OJSC on the basis of competitive bids submitted by another founder, apart from the state, chosen by the results of the tender or direct negotiations, ensures the development of a business plan for the investment project.

Development of a business plan for an investment project is carried out in accordance with the Regulation on the development, approval, examination, coordination and implementation of forecasts for the development of commercial organizations for five years, business plans for their development for a year, business plans for investment projects, approved by the Council of Ministers of the Republic of Belarus from August 8, 2005 № 873.

If another founder of the OJSC makes a non-monetary deposit to the statutory fund of the newly established JSC, an expert examination of the reliability of the valuation of the property in accordance with the procedure determined by law shall be carried out.

State Property Committee, regional, Minsk city territorial funds of state property:

control that the deposit by another founder, apart from the state, is made in full before the date of the constituent assembly. In case of failure to pay the deposit, it will annul the results of the tender for choosing another, apart from the state, founder and return the project of transformation of the republican unitary enterprise into an OJSC;

organize the holding of the constituent assembly which approves: the transfer act, the amount of the statutory fund and deposits of the founders of the OJSC, the charter of the OJSC, the decision to issue shares of the OJSC, and other issues are resolved in accordance with the legislation;

issue an order to transfer state property to the statutory fund of the OJSC being established.

Information support for privatization processes is carried out by publishing information messages in at least one of the following newspapers: "Sovetskaya Belorussia", "Respublika", "Zvyazda", "Narodnaya Gazeta", "Belorusskaya Niva", "Minsky Courier" and "Vecherny Minsk", as well as in the global computer network "Internet".

Information on the conduct, conditions of auction / competitive bidding and the list of documents required for filing an application for participation in the auction/bidding are placed in the mass media no later than 45 days before the auction/bidding, including: notifications in central republican and city print media ; commercials on radio and television; announcements on the website of the State Property Committee of the Republic of Belarus www.gki.gov.by in the section "Bidding, auctions, tenders" and the website of the Minsk City Executive Committee www.minsk.gov.by in the section "Power", subsection "State Property Fund".

4.2.4. Holding an auction / tender for the sale of privatization objects

To participate in an auction / tender, it is necessary to submit by the time fixed in the notice the following documents:

an application for participation in an auction / tender in accordance with the established form;

for legal entities - residents of the Republic of Belarus - copies of the charter (constituent agreement - for a commercial organization that operates solely on the basis of a memorandum of association), which has a stamp indicating the state registration, and certificates of state registration and their originals to certify the copies by the auction organizer, a power of attorney to the representative of a legal entity (if a legal entity is not a manager) or a document confirming the authority of the head of a legal entity (an order to appoint a manager, or a certified extract from a decision of a general meeting, board or other management body of a legal entity in accordance with the constituent documents, or an employment agreement (contract), or an appropriate civil law contract);

for legal entities, other organizations - non-residents of the Republic of Belarus - copies of the constituent documents and an extract from the trade register of the country of origin legalized in accordance with the established procedure (the extract must be made not earlier than 6 months before the date of submission of the application) or other equivalent proof of the legal status in accordance with the legislation of the country of origin with a notarized translation into Belarusian or Russian, a legalized, in accordance with the established procedure, power of attorney to the representative of a legal entity, an organization, or other duly legalized documents with a notarized translation into Belarusian or Russian language;

for individual entrepreneurs - residents of the Republic of Belarus - a copy of the certificate of state registration and the original for certifying the copy by the auction organizer;

for individual entrepreneurs - non-residents of the Republic of Belarus - a document, legalized in accordance with the established procedure, confirming the status, with a notarized translation into Belarusian or Russian;

for representatives of citizens of the Republic of Belarus, individual entrepreneurs - residents of the Republic of Belarus - a notarized power of attorney;

for representatives of foreign individuals, individual entrepreneurs - non-residents of the Republic of Belarus - a power of attorney, legalized in accordance with the established procedure, with a notarized translation into Belarusian or Russian.

When submitting documents for participation in an auction / tender, individuals, individual entrepreneurs, representatives of individuals, individual entrepreneurs, legal entities, other organizations present the original of the identity document and submit a copy thereof, which is certified by the auction organizer.

Persons wishing to participate in an auction / tender for the sale of shares in addition, in the cases established by the legislation, submit a document confirming the consent of the antimonopoly body for the transaction.

The organizer of the auction / tender, within 20 calendar days from the date of the auction / tender, concludes a contract of sale and purchase of the privatization object with the participant who has won the auction, signed the protocol on the results of the auction / tender and reimbursed the costs for organizing and holding the auction / tender, or with the sole participant in the auction / tender who has signed the protocol on the sale of the privatization object to the sole participant in the auction / tender and reimbursed the costs for organizing and holding the auction / tender.

When the auction is declared invalid because the application for participation in it was submitted only by one participant (the bidder for the purchase), the object of the auction is sold, at his consent, to this person at the initial price, increased by 5 percent.

When an application (request) for participation in a tender is received from one participant only, and if his/her proposals comply with the terms of the tender, the object of the tender is sold to that person on the terms proposed by him.

4.2.5. Establishment of joint business entities

The procedure for the adoption by the Minsk City Executive Committee of a decision to give consent to the establishment of a non-state legal entity by a state legal entity (membership in a participant) is defined in point 4.1 of paragraph 4 of the Instructions on the Management and Disposition of Property Owned by the City of Minsk, approved by the Decision of the Minsk City Council No. 87 of April 25, 2000:

«The Minsk City Executive Committee creates municipal legal entities, funds. Decisions of the Minsk City Executive Committee on the establishment of municipal legal entities, funds, reorganization and liquidation of municipal legal entities, participation in economic societies (partnerships) are accepted after obtaining the consent of the permanent commission of the Minsk City Council of Deputies on Economic Development, Finance and Budget and in the presence of the Expert Council conclusion which is created by the Minsk City Executive Committee, with the exception of the cases when shares in the municipal ownership of the city of Minsk are accepted (shares in statutory funds) of business entities (partnerships), transferred from the ownership of the Republic of Belarus or communal ownership of other administrative-territorial units."

Expertise of projects on the establishment of legal entities with a share of communal property, as well as control over the implementation of projects is carried out by an Expert Council, the Regulations on which were approved by the Decision of the Minsk City Executive Committee of No. 2278 of November 11, 2006.

4.3. Alienation of state property

State property that is not subject to privatization can be purchased at auction / competitive tenders or by selling to the lessee the property that it has leased for at least 3 years.

Granting the right of preferential purchase of property to business entities does not cause the owner of the property to perform the alienation on this ground, because by virtue of Article 210 of the Civil Code of the Republic of Belarus, the owner owns the rights to own, use and dispose of his/her property.

Procedural issues of preparing draft decisions of the Minsk City Executive Committee on the sale of state property are managed by the Fund's securities management, alienation and organization of the tenders.

On the basis of the Decision of the Minsk City Executive Committee No. 988 of March 22, 2012 "On some issues of disposal of communal property and the creation of a coordinating council for the management of municipal property of the city of Minsk," the administration of the districts of Minsk form lists of real estate for possible alienation, according to tenants. The lists are coordinated with the Coordination Council in order to prepare proposals to the leadership of the Minsk City Executive Committee for making managerial decisions on the issues of disposal of communal property.

The order of alienation of the property of communal property in Minsk is determined by the Instruction on the Management and Disposition of Property Owned by the City of Minsk, approved by the Decision of the Minsk City Council of Deputies No. 87 of April 25, 2000. The contracts of sale and purchase of projects owned by the city of Minsk are concluded in accordance with the “Approximate Form of the Contract of Sale”, approved by the Decision of the Minsk City Executive Committee No. 4089 of December 27, 2012.

4.3.1. Holding auctions for the sale of objects owned by the city of Minsk at auctions / tenders

The subject of the auctions are alienation objects located in the municipal property of Minsk:

capital buildings (buildings, structures), isolated premises, parking spaces, unfinished laid-up capital structures, other real estate, unfinished unsecured capital structures (shares are in the right of common ownership of them);

machinery, equipment, vehicles, other movable property relating to fixed assets.

Information about holding auctions / tenders is placed:

in the newspapers "Minsk Courier", "Evening Minsk";

on the website of the Minsk City Executive Committee www.minsk.gov.by;

on the website of the State Property Committee of the Republic of Belarus www.gki.gov.by

on the website of the municipal unitary enterprise "Minsk City Real Estate Center" www.mgcn.by.

Sale of objects of alienation at auctions, by competition is open.

Action participants may be citizens of the Republic of Belarus, legal entities and individual entrepreneurs of the Republic of Belarus, as well as foreign investors (foreign countries and their administrative and territorial units represented by authorized bodies, international organizations, foreign legal entities, foreign organizations that are not legal entities, established in accordance with the legislation of foreign states, foreign citizens, citizens of the Republic of Belarus and stateless persons constantly living outside the Republic of Belarus), unless otherwise stipulated by legislative acts.

Auction on the sale of state property and land in private ownership or on the right to conclude a lease contract necessary for servicing real estate

The subject of the auction is real estate and a land plot or the right to conclude a lease contract for a land plot necessary for servicing this property. The initial price of the subject of bidding is defined as the sum of the initial price of the immovable property and the initial price of the land plot or the initial price of the right to conclude a lease contract for the land plot required to service this property.

Persons wishing to participate in the auction must submit an application to participate in the auction in the form approved by the State Property Committee, to which the following documents are attached:

a document confirming the deposit  (deposits) paid to the current (settlement) bank account specified in the notice, with the bank note;

a legal entity or an individual entrepreneur of the Republic of Belarus attaches a copy of the document confirming the state registration of this legal entity or individual entrepreneur, without notarization;

a foreign legal entity attaches legalized copies of the constituent documents and an extract from the trade register of the country of the institution (an extract must be made not earlier than six months before the submission of the application for participation in bidding) or other equivalent proof of the legal status in accordance with the legislation of the country of the institution with a notarized translation into Belarusian or Russian;

a foreign individual entrepreneur attaches a document, legalized in accordance with the established procedure, confirming the status, with a notarized translation into Belarusian or Russian;

a representative of a legal entity of the Republic of Belarus attaches a power of attorney issued in accordance with the procedure established by law (except when the legal entity is represented by its head);

a representative of a citizen or an individual entrepreneur of the Republic of Belarus attaches a notarized power of attorney;

a representative of a foreign legal entity, a foreign individual or an individual entrepreneur attaches a power of attorney legalized in accordance with the procedure established by law, with a notarized translation into Belarusian or Russian.

When submitting documents, the applicant (his representative) presents an identity document, and the head of the legal entity presents also a document confirming his authority (the order to appoint a manager, or a certified extract from the decision of the general meeting, the board or other management body of the legal entity in accordance with the constituent documents, or labor contract, or the relevant civil law agreement, or other documents in accordance with the law).

Consolidated participants to participate in the auction attach to the relevant application the following documents:

the original and a copy of the contract for joint participation in the auction;

a document confirming the amount of the deposit (deposits) paid to the current (settlement) account specified in the notice, with the bank note;

copies of documents confirming the state registration of individual entrepreneurs and (or) micro-organizations that have concluded a contract for joint participation in the auction;

information on the average number of employees of microorganisms certified by the signature of the head and the seal.

When submitting documents, the authorized person (his representative) presents an identity document and powers of attorney issued by individual entrepreneurs and (or) microorganisms that have concluded the contract for joint participation in the auction. The representative of the authorized person shall additionally submit a power of attorney issued in accordance with the procedure established by law or a document confirming the authority of the head:

If the auction is declared invalid because the application for participation in it is submitted only by one participant, the subject of the auction is sold to this participant (the bidder for the purchase) with his consent at the initial price, increased by 5 percent. With the winner of the auction the following documents are concluded:

seller - a contract of sale of the property;

local executive committee - the lease of the plot of land.

The organizer of the tender for the sale of real estate objects that are in state ownership and land plots in private ownership or the right to conclude a lease contract for a land plot for servicing immovable property is the "Minskgorimuschestvo" Fund, the management of securities, alienation and organization of the Fund's auctions.

4.4. Acquisition of plots of land located in the city of Minsk

By the decision of the Minsk City Executive Committee of December 26, 2013 № 3315 "On some issues of organizing and holding auctions for land in Minsk in 2014" the municipal unitary enterprise "Minsk City Real Estate Center" is determined by an authorized organization to hold auctions in Minsk:

on the right to conclude lease contracts for land plots for lease to citizens, individual entrepreneurs and legal entities;

with the conditions for the right to design and build capital structures (buildings, constructions) for their lease to individual entrepreneurs and legal entities;

on the sale of land plots in private ownership - to private property for citizens of the Republic of Belarus for the construction and maintenance of single-family, blocked dwelling houses (except for cases when land plots are in use, lifelong inheritable possession of these citizens or on lease, but with located on them residential buildings owned by citizens on the right of ownership), as well as to non-state legal entities of the Republic of Belarus in cases provided for by legislative acts.

The organization and holding of auctions is carried out in relation to the land plots included by the decisions of the Minsk City Executive Committee in the relevant lists. The information is available on official websites:

4.5. Organization of electronic bidding for the sale of state property

The Resolution of the Council of Ministers of the Republic of Belarus No. 608 of July 12, 2013 approved the Regulation on the procedure for conducting electronic auctions on the sale of state property, including land plots, the right to conclude a lease contract for state property, including land plots.

In 2014, in accordance with this Resolution, the subject of electronic trading may be state-owned:

capital structures (buildings, constructions), isolated premises, parking spaces, unfinished conserved capital structures, other real estate (hereinafter, unless otherwise indicated, real estate);

unfinished unsecured capital structures;

shares in the right of common ownership of immovable property and unfinished unsecured capital structures (hereinafter - share in the right of common property);

machinery, equipment, vehicles, other movable property relating to fixed assets (hereinafter - movable property);

plots of land sold to private ownership of Belarusian citizens for construction and maintenance of single-family, blocked residential buildings, as well as non-state legal entities of the Republic of Belarus (hereinafter, unless otherwise specified, - plots of land sold to private ownership);

the right to conclude lease contracts for land plots;

the right to conclude lease contracts for capital structures (buildings, constructions), isolated premises, car places, their parts (hereinafter referred to as the right to conclude a lease of property).

The validity of this Regulation does not apply to the organization and conduct of electronic trading on the sale of:

residential houses and living quarters, including those not completed by the state-owned construction;

shares (stakes in statutory funds) of business entities (partnerships), including those in the operational management or economic management of state legal entities;

securities;

state property, confiscated, arrested, confiscated or turned into the income of the state in another way;

state property which is levied against the unsettled tax liability, unpaid penalties;

state property which is levied for execution of court decisions;

state property in the process of economic insolvency (bankruptcy);

property of the state legal entity in the process of liquidation of this person;

state property in the process of privatization;

liberated material resources of the Armed Forces, other troops, military formations and paramilitary organizations of the Republic of Belarus in the form of movable property and aircraft, inland navigation vessels and "river-sea" vessels.

The sale of the subject of electronic trading in electronic trading is carried out in cases where this is provided in the decision on its sale, adopted in accordance with the procedure established by law. Electronic bidding is open.

Participants in electronic bidding may be persons who, in accordance with legislative acts, may have, on the right of ownership or other proprietary right, property offered for electronic bidding, with the exception of cases provided for in this Regulation.

Electronic trading is conducted on the electronic trading platform in accordance with the regulations approved by the operator of the electronic trading platform, in compliance with the requirements of the Regulations.

The seller of the subject of electronic trading (hereinafter referred to as the seller) is:

on sale of immovable property, unfinished unsecured capital structures, shares in the right of common ownership, movable property:

a state legal entity for which the state-owned property is fixed on the right of economic management or operational management;

a state body (state organization) that has concluded a contract for the uncompensated use of property in state ownership;

on the sale of the right to conclude a lease of property – the lessors;

on the sale of land in private ownership and the right to conclude lease contracts for land plots - the local executive committee.

The subject of electronic trading can consist of one or several things and (or) one or several property rights.

The realization of the subject of electronic trading is only for cash.

As the authorized to conduct electronic bidding for the sale of state property, including plots of land, the right to conclude a lease of state property, including plots of land, are recognized the Minsk City Real Estate Center and the Belarusian Universal Trade Exchange.

Currently the MUE "Minsk City Real Estate Center" carries out work on creation of ETP on the basis of which it will be possible to conduct electronic auctions for the sale of real estate located not only in Minsk, but also in any locality of the Republic of Belarus.

4.6. Use of state real estate by investor

By the Decision of the Minsk City Executive Committee of 20.02.2014 No. 446 "On the issues of involving in the economic circulation of unused property owned by the city of Minsk and the recognition of certain decisions of the Minsk City Executive Committee as invalid," was approved the list of unused and inefficiently used property owned by the city of Minsk for 2014 (hereinafter - the list) and the calendar schedule of its involvement in the economic turnover (hereinafter - the calendar schedule).

The formed list for 2014 includes 9 unused facilities offered for disposal through sale at auction.

The formed calendar schedule includes: 2 objects subject to leasing. In addition, the schedule includes 3 objects to be demolished and 3 objects to be conserved.

The list and calendar schedule include 17 unused objects owned by Minsk, subject to involvement in economic circulation and demolition and conservation in 2014.

The Department for the Disposal and Use of State Property and Control of the Fund "Minskgorimuschestvo" collects and summarizes:

information on the availability of unused and inefficiently used areas owned by the city of Minsk;

information on unused premises and areas of organizations of republican property and organizations with a share of municipal and republican property located in Minsk. The information is posted on the official Internet portal of the Minsk City Executive Committee in the section "Real Estate" www.minsk.gov.by and in the Unified Information Base of unused state property on the official Internet portal of the State Property Committee of the Republic of Belarus www.gki.gov.by.

More detailed information on unused and inefficiently used state-owned real estate objects located on the territory of Minsk can be obtained from the Office for Disposal and Use of State Property and Control of the "Minskgorimuschestvo" Fund.
